Officials say Venezuelans who were deported by the military after a judge ordered the government not to deport illegal immigrants immediately.
On April 28, a federal judge asked the US government to respond to the deportation that occurred after handing over a provisional injunction imposing the new requirements.
US Department of Justice attorney Jonathan Ginn provided the same argument at Monday’s hearing.
Murphy questioned how the Department of Defense could fly without working with the DHS. The DHS is tasked with overseeing immigration and customs enforcement, overseeing detained immigrants and carrying out deportation.
“What kind of authorities does DOD have to have to make its deportation happen?” Murphy asked.
Ginn said he couldn’t deal with the question immediately, saying, “It was a new day and there were many changes.” He said further briefings should be submitted on the issue.
“The defendant cannot blatantly ignore the court’s orders, with another government, department or agency, simply completing the final step,” said Trina Lelmuto, an attorney for the National Immigration Litigation Alliance, who represents an immigrant group that has pursued lawsuits before Murphy.
Realmuto urged Murphy to amend an injunction to ban the removal of such immigrants from Guantanamo. He said he would control by Thursday.
The Department of Defense did not respond to requests for comment.
After the hearing, Murphy ordered officials to provide the migrant’s name with a final removal order deported on two flights that occurred around March 31 and April 13, identifying additional flights that removed illegal immigration from Guantanamo Bay to a third country before those dates.
He also directed the parties to submit a joint discovery plan that addresses topics such as the Department of Homeland Security and the Department of Defense relationship. We will introduce whether they are expressing their understanding between the role of each agency in rescue, management of Guantanamo Bay, March 7, 2025, and the understanding between the two suspects.
