The new positions were outlined in the April 8th filing.
Department of Justice (DOJ) officials said in a new court filing that some people faced with charges related to January 6, 2021 should refund the money they paid in compensation for violations at the Capitol.
Prosecutors at the District of Columbia’s U.S. Lawyer’s Office in a filing on April 8 said that Stacey Hager, who was pardoned, is entitled to a refund of $570 paid under a court order.
Officials at the DOJ said they agreed that Hager was eligible for the $500 he paid in repayments and the $70 he paid in fees.
Many pardoned defendants are not eligible for a refund, but prosecutors said they refer to the same Supreme Court decision, saying that those who are not resigned because the case is invalid and do not retire are eligible.
“Here, when the DC Circuit left it, Hager’s conviction was “null” and “there is no more grounds to justify the government’s maintenance funds that were enforced solely as a result of that conviction,” they cited, citing another decision. “In this way, we agree that Hager is entitled to a refund for those payments, as long as the Court Clerk has confirmed that he has indeed paid the special assessment and compensation that he is seeking to return.”
The judge overseeing the case has yet to control Hager’s claim.
A lawyer representing Hager declined to comment.
Officials estimate that the January 6 violation left a loss that cost $2.7 million to repair.
Many convicted people were ordered to repay prison sentences and fines, typically between $500 and $2,000.
It is not clear how much money is being paid in total in compensation.
The Capitol architects, who are responsible for maintaining the Capitol and other historic buildings nearby, did not return the investigation.
The District of Columbia’s US Lawyer’s Office did not respond to requests for details as to where the money would come from if the claim was granted.
“I think everyone who was targeted on January 6th should get a lot of money, like the asbestos money they got for asbestos victims,” he said at the time.
