TALHASSEE, Fla. (WFLA) — More than three months have passed since the fatal mass shooting on Florida State University’s campus, investigations remain active.
This greatest legal development in the state and Ichner case is that it has not yet happened. A week ago, Phoenix Echner’s defense attorney Peter Mills said they would file for discovery within a week, but court records show there has been no action yet.

This delay could dramatically shift the trial timeline, pushing it back to months, or even months.
“In spite of what the defense said, they have not submitted a request for discovery at this point. Once again, they are prepared to respond if they are.
That filing would cause the release of many evidence, including videos of sitting time from the day of the deadly shooting.
“From the students taking it to the surveillance to the police body cams, everything is all we’ve collected and organized, it’s far more appropriate than the others, but technically every camera that recorded everything on campus would be potential evidence,” Campbell said.
As of now, the trial is scheduled to begin with the selection of a ju judge on November 3rd, and if that applies, the case could move directly to the opening statement of that day.
As for motivation, Campbell says that due to the role of ethics, arguments of fact or evidence are inappropriate before the ju apprentice is selected.
“I am ethically prohibited from talking about facts and evidence,” Campbell said. “Through the trial, I’ve only spoken about the evidence.”
The defense has not yet submitted for discovery, but they will still need to request access to the evidence being presented to Phoenix Echner until October.
