Last year’s legalization of marijuana, known as Amendment 3, received 56% of votes, but didn’t reach the 60% needed to pass.
Currently, the next marijuana legalization initiative is to sign the November 2026 vote.
Political committee Smart & Safe Florida is not wasting time. We have submitted 613,206 valid petition signatures with 880,062 signatures that must be placed in the 2026 state vote.
The new name for the marijuana proposal is “Adult Personal Use of Marijuana.” According to Smart and Safe Florida, the new measures allow adults over the age of 21 to own, buy and use pots for non-medical purposes.
The group is also adding some additional protections that voters may help on the next journey, including banning product marketing to children and banning vaping and public smoking.
In this proposal, Smart & Safe Florida wants a licensed medical marijuana treatment center and the opportunity to sell marijuana to those over the age of 21 for recreational use. If passed, state legislators will need to set requirements for a new licensing framework for non-health vendors.
There is still a debate as to how it contradicts federal law if the amendment passes. This is to classify marijuana as a controlled substance.

And of course, the politics behind it. In 2024, Trump then supported legalization, but opposed Florida Gov. Ron DeSantis.
And will there be some asylum within the GOP on this issue due to the conflict between the GOP-controlled legislature and the governor?
Analysts say smart and secure Florida is ahead of the game on the petition for measures that will be featured in the 2026 poll.
By February 1, 2026, sufficient signatures must be submitted and verified by the state.
