Florida begins implementing new hemp regulations

TAMPA, Fla. (WFLA) – New hemp regulations will come into effect in Florida starting Monday.

The Florida Department of Agriculture says it will implement packaging, labeling and marketing standards.

Hemp products must have a child-resistant packaging, no cartoons or images to appeal to children, must have a scannable QR code that shows the size of the home measurement and includes product testing information.

Additionally, new regulations force the product to show confirmation of the presence or absence of prohibited substances and pathogens, including all lab information, total delta 9thc concentrations

“The Florida Department of Agriculture and Consumer Services has made that clear. Hemp products manufacturers and retailers must comply with the law, especially when it comes to child protection,” said Agriculture Commissioner Wilton Simpson. “Our department is already taking proactive action to obtain dangerous and misleading products from store shelves, especially products that mimic candy or target minors. The date of enforcement of the revised rules is approaching. Reliance on violations will be zero.

Simpson said hemp food facilities are strongly encouraged to review products, labeling and packaging practices to ensure compliance with the revised regulations by Monday’s enforcement date.

The department said it has discovered more than 726,000 packages of hemp products targeting children since July 1, 2023.
