WINTER PARK, Fla. (WFLA) – Buc-EE hopes to bring a Florida store on its court over imitation products that appear to imitate the mascots of popular convenience stores.
According to court documents, Prometheus Esoterica, a “gothic boutique” in Winter Park, sells products such as t-shirts and decals, featuring what looks like the Buc-EE beaver logo with a punk rock makeover.
The document showed that the shop “explicitly advertised” the product as a “batch-sea” shirt.
“(Prometheus esoterica) intentionally copied the Buc-ee mark to simulate a well-known brand (of Buc-EE) and exploited public goodwill associated with the plaintiff’s Buc-EE mark,” the lawsuit read.
The lawsuit stated that the store deceived the customer by believing that the customer was affiliated with Buc-ee, and that the actions were “intentionally and maliciously accepted.”

Buc’ee has charged Prometheus Esoterica, who was accused of trademark infringement, unfair competition, counterfeiting trademarks, unfair enrichment and violations of Florida’s unfair trade practices law.
The lawsuit also called for future sales of Prometheus Esoterica products to be sold and prevented Buc-EE from paying the damages suffered.
The Florida store must reply to the complaint within 21 days, the lawsuit stated.
