FORT MYERS, Fla. (WFLA) – A man allegedly confused about the building numbers and accidentally entered the wrong apartment was shot dead last week.

Juan Diego, 28, lived in Carlton, the Fort Myers apartment in Building 5, his brother Miguel told NBC affiliate WBBH. On the night of April 10th, Diego entered the apartment with as many as himself, but is reportedly four buildings.

The Fort Myers Police Department said Diego, who was then armed with firearms, was about to enter the apartment. According to WBBH, residents inside felt threatened as Diego was knocking on the front door.

Residents called 911 around 11:40pm and told authorities they fired one shot at an armed intruder trying to enter the home.

Authorities are investigating the incident as a potential “standing on your ground” incident. Florida law states that if a person attempts to “enter an individual into a person’s residence, residence, or occupied vehicle, illegally and by force, they have the right to defend themselves.

WBBH said no arrests had been made at the time of the report.

Diego’s family mourned his death outside his Fort Myers home Tuesday night and stayed up all night to share memories, WBBH said.

WFLA.com contacted the apartment and the Fort Myers Police Department for additional information regarding the incident.
