Edward Kelly was accused of plotting to kill an FBI agent in 2022 and was convicted in 2024.
President Donald Trump’s pardon for those charged with violations of the US Capitol on January 6, 2021 does not cover a 2024 conviction that attempted to kill FBI agents, according to the US Department of Justice. DOJ) The lawyer said on February 18th.

They also argued that if Kelley was not provided with unedited discovery documents in the January 6 case identifying FBI personnel, they could not develop the so-called hit list.
However, the DOJ lawyer said that his view was wrong as Kelly’s actions occurred almost two years later and took place in another part of the country.
“Based on the clear language of the declaration and after consultations with Department of Justice officials, the United States is opposed to the defendant’s allegations of dismissal,” they said Tuesday.
“The Attorney General has administered and was affected by the President’s declaration. The defendant’s DC case has been dismissed. The declaration does not provide relief in regards to the defendant’s crimes in Tennessee. The case has been dismissed. It should not be, and the defendant should be declared as planned.”
US District Judge Thomas A. Baran is overseeing the case and will decide Kelly’s allegations at some point in the future.
Kelly is not the only person facing charges in another case on January 6th.
Ball’s lawyers say they believe the charges should be dismissed as they stem from a search warrant carried out in the January 6 case.
