Guatemalan man indicted in Jacksonville for federal fraud and immigration accusations

JACKSONVILLE, Fla. — According to the US Lawyer’s Office for the Central District of Florida, the federal ju court has indicted Guatemalan citizens on multiple charges related to immigration fraud and illegal re-entry into the United States.

Diego Andres Garcia, 45, is faced with accusations of possessing false documents, misrepresenting his Social Security number and illegally re-entering the United States after deportation. If convicted, Garcia could have up to 10 years in federal prison for document fraud charges, up to 5 years for social security violations, and up to 2 years for illegal re-entry crimes.

Court records show that in July 2024, Homeland Security Investigation (HSI) conducted a workplace immigration compliance inspection at a Jacksonville construction company. Investigators allege Garcia submitted a forged permanent resident card and a Social Security card and misrepresented the immigrant status in order to acquire employment.

Garcia was arrested on July 17, 2025. During the process, authorities reportedly found that they had previously been deported from the United States in both 2006 and 2013 and re-entered without approval from the Attorney General or the Secretary of Homeland Security.

The case is being investigated by a Homeland Security Investigation and is being charged by Assistant U.S. Attorney Kevin C. Freyne.

Garcia’s charges are part of Take Back America, a Department of Justice initiative targeting immigration violations and cross-border criminal activity.

The charges are formal charges and Garcia is presumed to be innocent unless proven guilty in court.
