“Granting a provisional injunction in these circumstances would pose serious difficulties on the NEA,” the judge said.

A federal judge on Thursday denied a motion to stop the Arts Fund (NEA) from blocking funding for art projects that promote “gender ideology” because the agency has not implemented certification requirements.

Judge William Smith of Providence, Rhode Island denied allegations filed by several arts and theatre groups seeking preliminary injunctions.

Groups – Rhode Island Latin Arts, National Queer Theatre, Theatre Attacks and Theatre Communications Group, expressed by the American Civil Liberties Union, which was sued last month, said the move violated the First Amendment, the Administrative Procedure Act and the Fifth Amendment.
