A page attached to the warrant states that Ball, a Florida resident, is a “two-time convicted felon with a prior conviction for domestic violence, including strangulation and resisting law enforcement with violence. ” is stated. The warrant was signed on August 6, 2024, but was not executed until this week.
It is unclear why the warrant was not executed until now. The U.S. Department of Justice did not respond to a request for comment.
Ball was arrested while in prison in Washington, his attorney Amy Collins told The Epoch Times.
According to the indictment, Ball’s illegal possession of a firearm was discovered on May 2, 2023.
Authorities arrested Ball on May 2, 2023, for the January 6 incident.
President Trump’s order grants full, complete, and unconditional pardons to people convicted of crimes “related to the events that occurred at or near the U.S. Capitol on January 6, 2021.” .
The law would direct the attorney general to immediately issue certificates of clemency to January 6 defendants, providing for “immediate release” of people convicted of January 6-related crimes and currently in prison. We are instructed to ensure that.
“I further direct the Attorney General to seek dismissal with prejudice to the government of all pending charges against individuals related to the events at or near the U.S. Capitol on January 6, 2021. ” President Trump wrote.
Collins said Ball’s lawyers believe any new lawsuits should be dismissed under the pardon.
“Among other things, this stems directly from the search warrant executed in the Jan. 6 incident,” Collins said.
Ball was charged with multiple charges in connection with the Jan. 6, 2021, breach of the U.S. Capitol, including assaulting, resisting, and obstructing a law enforcement officer with a dangerous weapon.
At one point, prosecutors said, Ball threw an explosive device into the tunnel leading to the Capitol and threw chairs and table legs at police officers who were there.
Mr Ball, who has maintained his innocence, has been in custody since 2023 after a magistrate ruled there were no conditions that would reasonably guarantee the safety of the community if he was granted pre-trial release.
