Officials say Ichner was shot in the jaw once after refusing to comply with the officer’s orders.
There was no clear timeline for Ichner’s discharge from the hospital yet. However, he will be formally charged upon release.
Police were unable to speak about the specific charges, but said it would “include first-degree murder.” The State Attorney’s Office will make an official decision.
Two foodservice employees identified as Tiru Chabba, the father of two, 45, and FSU alumnus Robert Morales were killed in the April 17 shooting.
The other six were taken to Tallahassee Memorial Hospital due to injuries. All but one of the patients were then discharged, according to the hospital.
The motive for the shooting remains unknown as Ichner refused to talk to police.
Court records revealed more about Ichner’s past, including that he had some physical and mental health issues.
He is also the son-in-law of a deputy Leon County and is believed to have access to her weapons.
