Oklahoma secured a preliminary injunction last July, preventing the Department of Education from issuing new Title IX regulations.
The Trump administration has dropped a federal appeal of a preliminary injunction that prevented the government from extending gender identity discrimination protections to the education sector.
The appeal was launched by the Biden administration, which took office on January 20th, but the new administration decided not to pursue it. In many cases, when a new president takes office, the new administration changes its position in the case already in front of the courts.
Oklahoma received an injunction from a federal district judge last summer after the Biden administration moved to amend Title IX regulations covering gender-based discrimination at educational institutions to include discrimination based on gender identity. Other courts also blocked efforts to change regulations.
Title IX refers to the Public Law 92-318, or the Federal Education Amendment Act of 1972, amending four federal education-related laws.
In 1980, the U.S. Court of Appeals for the Second Circuit ruled that Alexander v. Yale University constituted sexual discrimination under Title IX.
Dishman wrote this rule by ordering that “gender identity missions are inexplicably logically inconsistent with some of the provisions of Title IX.”
The rules identifies the woman sleeping in boys’ dorms, but at the same time requires him to be allowed to use the girls’ locker room, she wrote.
“This approach represents the purpose of Title IX and represents a clear error in judgment and does not fully consider important aspects of the issues the department has sought to resolve,” the judge wrote.
The Biden administration appealed an injunction to the 10th Circuit in September 2024, but by the time it was rejected on March 14th, the case had not reached the oral stage.
In the letter, the Department of Education said it would implement the Title IX regulations introduced by the first Trump administration in 2020.
Oklahoma Attorney General Gentner Drummond welcomed the federal government’s rejection of appeal.
The Epoch Times contacted the Department of Justice for comment. There were no responses before the publication time.
